Swiss chocolate giant Lindt & Sprüngli is at the center of a legal battle in the United States after being accused of misleading consumers about the quality of its dark chocolate. A class-action lawsuit filed in 2023 claims Lindt’s premium products contain harmful levels of lead and cadmium, raising concerns about health risks.
What triggered the row?
A 2022 Consumer Reports study tested several brands of dark chocolate for the presence of heavy metals. The report revealed startling levels of lead and cadmium in Lindt's Excellence Dark Chocolate 85% Cocoa and 70% Cocoa variants, leading to plenty of outraged reactions to the brand.
While the scrutiny was multi-brand, Lindt became the epicenter of condemnation because of its reputation as a maker of premium chocolate. The report alerted everyone to the possible long-term health effects of eating chocolate containing elevated levels of these metals.
Are heavy metals “unavoidable”?
In defense, Lindt countered that trace amounts of lead and cadmium are "unavoidable in the food supply" and stated that the quantities in its chocolates fall within limits established by regulatory bodies. The company also vetted its use of marketing language, saying the use of words such as "expertly crafted" and "finest ingredients" are forms of "puffery" rather than literal claims.
Though Lindt must have hoped that such an argument would help him get the case dismissed, instead, he elicited sharp criticisms from people in the public as well as the industry.
What does 'Puffery' mean for Lindt's reputation?
Puffery" is a term that characterizes exaggerated or marketing claims made without regard to their accuracy, which are not to be taken literally. Lindt's lawyers argued that no reasonable consumer would assume that such statements carried a guarantee of impurities in Lindt products.
However, this defense seemed to harm the company's reputation. It was criticized that Lindt was focusing on loopholes rather than doing what the company has always been known for: emphasizing quality.
The argument itself was termed as a "self-inflicted wound" by Swiss newspaper NZZ am Sonntag. It, in essence, blemished the credibility of the company.
It transcends to social media where disheartened customers raised their voice against the brand transparency and its ability to uphold luxury.
