Controversial Nazul Property Bill faces strong opposition in Uttar Pradesh

The Bill seeks to regulate Nazul land, which is government-owned but not directly managed as state property, to prevent its conversion into private ownership.

The Uttar Pradesh Nazul Property Bill, 2024, has recently garnered significant attention after its passage in the Legislative Assembly and subsequent referral to the House’s Select Committee. This development has not only sparked protests from the opposition INDIA bloc but also from members within the ruling Bharatiya Janata Party (BJP) and its allies. The bill’s journey through the legislative process has highlighted internal disagreements and raised concerns about its potential impact on disadvantaged communities.

Key Provisions and Objectives

The Uttar Pradesh Nazul Property Bill seeks to regulate Nazul land, which is government-owned but not directly managed as state property. The primary aim of the bill is to prevent the conversion of such land into private ownership. According to the bill, any payments made in anticipation of ownership changes will be refunded with interest, calculated at the State Bank of India’s Marginal Cost of Funds Based Lending Rate (MCLR) from the date of deposit.

The bill includes several provisions aimed at managing and utilizing Nazul properties for public purposes. These measures encompass lease renewals and the rehabilitation of economically disadvantaged individuals affected by the legislation. Specifically, the bill permits the extension of government leases for current leaseholders who consistently pay rent and adhere to lease conditions. This ensures that compliant leaseholders can continue utilizing the land while it remains government property.

Despite these intentions, the bill has faced strong opposition. Critics argue that it will create confusion and lead to the deprivation of vulnerable populations. The bill’s implications for the poor and economically disadvantaged have been a central point of contention.

Internal and External Opposition

The passage of the Nazul Property Bill has led to significant controversy within the BJP. Siddharth Nath Singh, a prominent BJP leader, addressed the situation by explaining that the Nazul Property Bill was tabled by Deputy Chief Minister Keshav Prasad Maurya in the Vidhan Parishad. The bill faced opposition from Bhupendra Chaudhary and was subsequently sent to the Select Committee after discussions with Chief Minister Yogi Adityanath. Singh’s comments highlight the internal disagreements and the complexities involved in the bill’s legislative journey.

One of the most vocal critics of the bill within the BJP has been Harshvardhan Bajpai, the BJP MLA from Prayagraj. Bajpai expressed strong objections to the bill, arguing that it would negatively impact the poor. According to The Indian Express, Bajpai was among the first to voice concerns, emphasizing the potential adverse effects on families living in historically significant areas. He noted that these families, some of whom have lived in these areas since British rule, would face displacement as a result of the bill’s implementation.

Bajpai’s objections were met with enthusiastic applause from the opposition, further highlighting the bill’s contentious nature. Despite repeated urgings from BJP leader and Uttar Pradesh Parliamentary Affairs Minister Suresh Khanna for Bajpai to thoroughly review the bill, Bajpai continued to criticize it, underscoring his concerns about its fairness and impact on vulnerable communities.

The Uttar Pradesh Nazul Property Bill has become a focal point of debate and controversy, revealing deep-seated divisions within the BJP and between the ruling party and the opposition. While the bill aims to regulate Nazul land and ensure its utilization for public purposes, the strong opposition and internal dissent suggest that its implementation will face significant challenges.

The bill’s provisions regarding lease renewals and compensation for payments highlight its intended objectives, but the concerns raised by critics, including members of the ruling party, underscore the complexities involved in balancing property management with the needs of disadvantaged populations. As the bill moves through the Select Committee, it will be crucial to address these concerns and seek a resolution that ensures fairness and equity for all stakeholders involved. The ongoing debate reflects broader issues of governance and social justice, making the outcome of this legislative process particularly significant for Uttar Pradesh and its residents.
