A man from Kalyan, Maharashtra, was arrested for allegedly giving triple talaq to his wife after she refused to engage in sexual activity with his boss. The incident, reported by News18 Marathi, also revealed that the man, Sohail Shaikh, a software engineer, had demanded his second wife arrange for Rs 15 lakh per month for his first wife. When she refused, he resorted to giving her triple talaq.
According to the report, Sohail Shaikh asked his second wife to sleep with his boss during a party, but she refused. Later, he demanded that she arrange Rs 15 lakh per month to give to his first wife. When she disagreed, Sohail gave her triple talaq and ordered her to leave the house. In response, the woman filed a complaint against Sohail at a local police station.
The police are currently investigating the case. However, there have been no reports of any arrests made so far in connection with the matter.
About Triple Talaq
Talaq is an Islamic term for divorce, allowing a Muslim man to end his marriage. Triple Talaq means that a man can divorce his wife immediately by saying "talaq" three times. This is also known as "talaq-e-biddat," which refers to the practice of instant divorce.
The Muslim Personal Law (Shariat) Application Act of 1937 made Triple Talaq legal, granting Muslim husbands the right to divorce their wives in this manner, giving them special privileges in marriage.
However, in 2019, the Muslim Women (Protection of Rights on Marriage) Act made instant divorce through 'triple talaq' a punishable offence, carrying imprisonment of up to three years.
What is the Talaq-e-Biddat Act
The Talaq-e-Biddat Act or the Muslim Women (Protection of Rights on Marriage) Act illegalizes and declares void talaq-e-biddat, the practice of instant and irrevocable divorce, in India and safeguards Muslim women from unfair divorces.
According to the Act, declaring talaq is declared a cognizable offence, that is, the accused may be arrested without a warrant and will face imprisonment for up to three years along with a fine. A complaint for such an offence can be filed only by the woman or her family.
